Chief Magistrate Court of Apac will, on February 11, 2026, hold a Preliminary Hearing of Election Petition challenging the victory of Jacob Edule of National Resistance Movement(NRM).
Edule, the NRM flag bearer for Aduku Sub-County LCV, a directly elected Councillor, was declared the winner by Shara Kezia Birungi, Kwania District Returning Officer, in the Local Government Election conducted on January 22.
According to Birungi, Edule garnered 4,091 votes against his only rival, Daniel of Odongo, Uganda Peoples Congress (UPC) flag bearer’s 3,987 votes, out of the 8,078 total votes cast.
Daniel Odongo contested the results, alleging electoral offences and gross irregularities. According to the Election Petition obtained by our reporter, the applicant claimed that he obtained 3,998 votes while the respondent, Jacob Edule, obtained 3,990 votes, giving the applicant a margin of only eight (8) votes, something he said creates reasonable doubt about the accuracy of the declared results.
He also accused Kwania District Police Commander Alison Arinda of unlawfully ordering his arrest, resulting in his assault, removal, and confinement, preventing him from observing or participating in the rallying process, rendering the declaration unreliable.
Through his lawyer of M/S Okwir & Co.Advocates, Odongo Daniel is seeking a recount of all votes cast in the Aduku Sub-County District Council Election and a subsequent court declaration.
Moses Odwono, Kwania UPC party Registrar, accused Kwania District Returning Officer of serving NRM’s interest and illegally declaring the NRM candidate. Odwono pledged total support to UPC candidate Daniel Odongo to ensure justice is served.
However, NRM candidate Jacob Edule, when contacted on phone calls and message declined to comment on the matter.
In its defense Kwania Electoral Commission Returning Officer also refuted Odongo’s petition, arguing the election was free and fair and administered in a neutral, accountable, and accurate manner.
The commission further stated that the declaration of Edule was based on verifiable results from the respective polling stations.
