Sitting Busiro East MP Emmanuel Magoola has submitted more than 130 Declaration of Results (DR) forms to the Uganda Police Directorate of Forensic Services for authentication, alleging that some of the documents filed by his election challenger are forged.
The development came up on Monday before Justice George Okello at Wakiso High Court, where Magoola is defending his victory against a petition filed by National Resistance Movement (NRM) candidate Hajji Abdul Kiyimba. Kiyimba is seeking to overturn Magoola’s election and has also sued the Electoral Commission, citing alleged irregularities in the tallying and declaration of results.
According to the declared results, Magoola, who contested as an independent candidate, polled 45,625 votes against Kiyimba’s 28,499, giving him a margin of 17,126 votes. However, the margin has not stopped Kiyimba from challenging the result, with his petition now turning partly on the authenticity of the election documents presented before court.
Appearing for Magoola, lawyer Davis Wesley Tusingwire told the court that the defence had identified DR forms from about 130 polling stations that it disputes. “My Lord, we have identified DR forms from about 130 polling stations, and we have already submitted them for authentication to the Directorate of Forensic Services,” Tusingwire said.
He said the documents had been submitted to the police forensic laboratory for analysis and that the defence had so far received only a partial report. Tusingwire said the defence expects to receive the full forensic report and had therefore placed the court on notice about the pending evidence. Magoola has also filed what his lawyers described as original DR forms issued to his polling agents on election day, together with copies of DR forms from the Woman Member of Parliament election held in the same constituency.
Tusingwire told the court that the Woman MP results could provide a basis for comparing the number of voters recorded in the two parliamentary races. “My Lord, the Woman MP DR forms are critical to this matter. First, the number of voters for the Woman MP must relate to that of the area MP,” he submitted. The comparison, he said, would assist the defence in challenging the accuracy of figures relied upon by Kiyimba in the petition.
Justice Okello asked the parties whether they had obtained certified copies of the DR forms from the Electoral Commission. Tusingwire said they had not, but explained that most of the forms filed by Kiyimba correspond with documents already in the defence’s possession, except for forms from several polling stations that Magoola intends to contest during the full hearing.
Both parties subsequently sought leave to file supplementary affidavits and rejoinders. Justice Okello granted the applications and issued separate timelines for the additional filings before adjourning the case to October 15, 2026.
