The High Court in Hoima has adjourned the hearing of an election petition challenging the victory of Asinansi Nyakato, the Woman Member of Parliament for Hoima City to October 8.
The petition hearing that begun on Thursday morning, saw Nyakato’s lawyers led by Counsel Medard Lubega Sseggona cross-examining Mugenyi the whole day. On Friday Mugenyi’s lawyers were supposed to cross-examine Nyakato and the Electoral commission.
However, the lawyers only crossed-examined the Electoral Commission (EC) officials and asked the presiding judge to adjourn the proceedings since they were fatigued and too exhausted.
Subsequently, Charlis Kasibayo, the presiding judge adjourned the election petition hearing until October 8 when both parties will return to court.
Addressing journalists shortly after the hearing had been adjourned, Humphrey Tumwesigye, one of the lawyers representing Mugenyi said it is true, they asked for an adjournment after they spent two days cross-examining witnesses adding that they were too exhausted.
He says the adjournment would help them further prepare and come back when they are fresh to undertake the election petition hearing.
On his part, Medard Lubega Sseggona, the lead lawyer for Nyakato said, they were ready to proceed with the case. He however, says, the adjournment would also give them more time to rest and prepare enough for the remaining witnesses to be cross-examined.
On her side, Nyakato said she is ready and prepared to be cross-examined on October 8 adding that, she cannot allow her victory to be robbed since she won the election in broad day light.
Meanwhile Mugenyi admitted that her lawyers were too tired following the two-day cross-examination marathon they undertook in court. She has appealed to her supporters to remain calm stating that, she has got sufficient evidence backing her petition-URN.
