Police Officer Nsiima Remanded over Slapping Supermarket Attendant

The City Hall Court has remanded Assistant Superintendent of Police Clive Nsiima Barigye to Luzira prison on charges of assault.

Nsiima who is a resident of Kyanja in Nakawa Division was on Monday afternoon arraigned before the Court presided over by Nicholas Aisu, Senior Principal Grade One Magistrate who is the in charge City Hall Court.

Nsiima who serves in the Counter Terrorism Directorate in the Oil and Gas Protection Unit, ran out of luck following the viral circulation of a CCTV video showing him assaulting a female supermarket attendant at the Shell Kyanja station. This was followed his refusal to clear a 30,000 shillings bill for products he had bought from the supermarket.

In the video in issue, a male adult in civilian clothes is seen slapping someone near the Supermarket Counter twice and bragging about his status asking whether the lady if she had ever driven such a car.

He asked whether the Lady thought he would run away over 100,000 shillings before slapping her twice on camera.

He was accordingly arrested and kept under police custody until today when he was arraigned before the Court.

He has then been today charged with two counts of assault occasioning bodily harm contrary to section 219 of the Penal Code Act and malicious damage contrary to section 312 (1) of the Penal Code Act.

The Court has heard that N/1817 Clive Nsiima Barigye on October 7th 2025 at Shell Petrol Station Kyanja in the Kampala District, willfully and unlawfully assaulted Pellan Atuhumuriize thereby occassioning her bodily harm.

 

It’s is also alleged that on the same day Nsiima allegedly willfully and unlawfully damaged the mobile Smart phone infinix Hot 10 Blue in Colour a property of the victim Atuhumuriize.

Nsiima has pleaded not guilty to the two charges.

Prosecution has told the Court that inquiries are complete and asked to be given a hearing date.

Through his lawyer Hamuza Kyamanywa the Court has heard that Nsiima has since reconciled with the complainant. The complainant was present in Court, standing in front but she didn’t deny the reconciliation nor say anything to confirm it.

The lawyer has applied for bail saying they had three sureties.

Nsiima has presented Mushabe Daniel Katanyomba, resident of Kisozi Ward, Kyengera Town Council and an employee of Internal Security Organization, his brother Mark Igumira resident of Kyaliwajala Namugongo Kira Municipality and Cynthia Nkwanzi, resident of 1-8 LC Village in Nakawa Division as his sureties.

The Court has heard that all the accused persons are presumed to be innocent unless proven to be guilty.

On the other hand, the Prosecution led by State Attorney Mercy Yamangusho said that the Nsiima’s lawyer has not told Court what the sureties do for a living.

That from what she has seen, the sureties seem to be younger than the accused and therefore they cannot compel Nsiima to return to Court.

Prosecution said Nsiima as a police officer was expected to keep law and order and the fact that he is the one accused of offenses related to violence, leaves a lot to be desired.

She said the victim is a woman and therefore it is an insult for a police officer instead of protecting her.

She noted that this offense has gone viral and it will affect on the public on how they feel about the Court.

The Prosecutor noted that the accused acted with impunity of the highest order where the Court has to send a message to the public. She said the public out there is very bitter and that the state investigations are still ongoing. As such, she said she objected to the release on bail to let the law to take its course.

In response, Nsiima’s lawyer said the surety, that is Daniel Mushabe, was 37 years old and works with Internal Security Organization.

The Lawyer said Court is supposed to promote reconciliation and the accused has already since reconciled with the complainant.

As regards public bitterness, the lawyer said this was submission from the bar and not supported by any evidence that the public is bitter.

He said it was the same public outcry that encouraged reconciliation and therefore presumption of innocence should be encouraged.

In his ruling, Senior Principal Magistrate Aisu has remanded Nsiima until October 16th 2025 for him to decide on the bail application.
