Five Councillors in Bushenyi have petitioned the High Court seeking a judicial review of the conduct of the District Council. The Councillors, including Douglas Mucunguzi, David Kakama, Anthony Asingwiire Katwarana, Denis Nayebare, and Allan Arinda, petitioned against the District Chairperson Prosper Twebaze, the District Speaker, Silagi Banyanga alias Fish, and the entire District Local Government.

The Councillors question the nomination and appointment of the District Vice Chairperson and members of the District Executive Committee- Bushenyi District. They are of the view that it was irregularly done without following the law. They state that the Bushenyi District Executive Committee was not properly constituted. They say that the procedure for nominating the persons, as adopted by the respondents, was marred with procedural irregularities and illegalities.

They say that the nomination and appointment of the members to the Bushenyi District Service Commission was null and void, since there wasn’t a validly constituted District Executive Committee to approve the nomination of members of the said District Service Commission. The councillors also want a declaration that the district council convened on 28th May 2026, was illegal, irregular, and not convened in accordance with the law and established standard rules of procedure for local government councils in Uganda.

They are alleging that the 1st and 2nd respondents acted ultra vires in convening a council sitting where the members of the District Service Commission were illegally and irregularly nominated, without first constituting the business committee and other standing committees. They pray that a prerogative order of certiorari doth issue quashing the disputed illegal and irregular appointment of the District Vice Chairperson and the Bushenyí District Executive Committee and also issue an order quashing the nomination of the District Service Commission conducted by a council sitting on 28th May 2026.

They want the court to order the respondents to reconvene a District Council Sitting and properly follow the law and rules of procedure guiding the local government councils in Uganda but also pay the costs of the Application. The councillors also pray that their application be allowed in the interests of natural justice, fairness, the rule of law, and equity.

On the 28th of May 2026, Bushenyi District held an emergency council sitting amidst chaos from some section councillors and approved the members of the District Service Commission.  They approved Martin Mugabe as chairperson of the commission alongside Rehema Kyarimpa and Counsel Julius Turinawe as members-URN.
